Company name registration requirements

Until a few years ago, the Company Law was the main law providing for reserving and registering company names in Vietnam. However, in 2014 the government issued Circular No. 10/2014 under which the trade name requirements became more stringent.

Both local and foreign enterprisers who want to set up companies in Vietnam must comply with the same business name registration requirements. Among these requirements are a few restrictions related to the use of names related to historical personalities of Vietnam. Also, the company name must be written in Vietnamese even if the company is foreign-owned.

Choosing and reserving a company name in Vietnam

According to the Enterprise Law, local and foreign enterprisers who open companies in Vietnam must following the next steps when reserving a business name:

–          they must select 3 business names and submit them with the Trade Register;
–          the trade name must comprise the name chosen by the enterpriser and the type of structure the company will operate under;
–          the company name may contain letters, numbers or symbols;
–          the trade name can be in other languages, but it must be translated into Vietnamese.

The business name reservation is filed with the Trade Register in Vietnam which will be the authority approving the name in a few working days.
